SOME OF THIS IS GOING TO BE FAMILIAR FROM OUR INDIVIDUAL PRESENTATIONS FROM A COUPLE OF WEEKS AGO, BUT TO MAKE SURE THAT WE'RE ALL ON THE SAME PAGE IN TERMS OF OUR LANGUAGE WITH RESPECT TO REDISTRICTING, REDISTRICTING REALLY IS THE PROCESS THAT WE GO THROUGH EVERY 10 YEARS UPON THE RELEASE OF CENSUS DATA TO LOOK AT WHETHER OR NOT WE NEED TO REBALANCE OUR SINGLE-MEMBER DISTRICTS BASED ON POPULATION CHANGES THAT HAVE OCCURRED WITHIN THE LAST 10 YEARS.

THE SPECIFIC TRIGGER FOR REDISTRICTING OR FOR REBALANCING IS IF WITHIN THE LAST 10 YEARS, BASED ON THE CURRENT CENSUS DATA, THE POPULATION CHANGE BETWEEN YOUR MOST POPULOUS DISTRICT AND YOUR LEAST POPULOUS DISTRICT IS GREATER THAN 10 PERCENT.

IF THAT HAPPENS, THAT'S THE TRIGGER FOR REBALANCING OR REDISTRICTING.

THAT NEEDS TO OCCUR 90 DAYS BEFORE THE FIRST ELECTION, YOUR FIRST REGULAR ELECTION FOLLOWING THE RELEASE OF CENSUS DATA.

IF THIS IS A SCHOOL DISTRICTS THAT HOLDS ELECTIONS IN MAY AND MUST HOLD ELECTIONS IN MAY, THAT WOULD BE 90 DAYS BEFORE YOUR MAY ELECTION IN MAY OF 2022.

THAT ELECTION DATE IS MAY 7TH OF 2022, LATER ON IN OUR PRESENTATION, WE'LL TALK A LITTLE BIT MORE.

WHILE THAT IS AN ABSOLUTE DROP DEADLINE, THERE IS AN EARLIER DEADLINE, DECEMBER OF 2021, WHICH IS ACTUALLY MORE APPROPRIATE BECAUSE IT ALLOWS US TO COMPLETE ALL OF THE REDISTRICTING ACTIVITIES PRIOR TO THE FIRST DAY FOR A CANDIDATE TO FILE FOR A PLACE ON THE BALLOT FOR YOUR MAY OF 2022 ELECTION.

ANY CANDIDATE THAT CHOOSES TO FILE ON THAT FIRST DATE TO FILE KNOWS THE ACTUAL BOUNDARIES IF THERE'S GOING TO BE A CHANGE IN BOUNDARIES OF THOSE SINGLE-MEMBER DISTRICTS THAT ARE UP FOR ELECTION DURING THAT ELECTION.

IF WE CAN GO TO SLIDE 6, PLEASE.

WITH RESPECT TO THIS REDISTRICTING PROCESS, IT IS A PROCESS THAT NOT ONLY INVOLVES A LOOK AT THE DEMOGRAPHICS AND CHANGES PHASE, BUT IT REQUIRES THE TRUSTEES AND THE ENTIRE LEGAL TEAM TO UNDERSTAND THE LEGAL REQUIREMENTS FOR REDISTRICTING, TO DISCUSS AND AGREE UPON WHAT CRITERIA ARE GOING TO BE USED FOR LOOKING AT ANY REDISTRICTED MAP? ARE WE GOING TO TRY TO THE EXTENT POSSIBLE, MAINTAIN EXISTING BOUNDARIES? ARE WE GOING TO NOT TRY TO CUT ACROSS COUNTY ELECTION PRECINCTS? WHAT ARE GOING TO BE OUR GUIDING PRINCIPLES THAT ALLOW US TO LOOK AT A MAP AND DECIDE, IN ADDITION TO THE LEGAL MANDATORY REQUIREMENTS.

HEY, WE HAVE TO REBALANCE BECAUSE OUR SMALLEST DISTRICT AND OUR LARGEST DISTRICT ARE OUTSIDE THAT 10 PERCENT DEVIATION, WHAT ARE ACCEPTABLE THINGS THAT WE CAN DO TO MOVE BACK INTO BALANCE? BUT OTHERWISE, OBSERVE TRADITIONAL REDISTRICTING PROCESSES.

OBVIOUSLY, THIS IS A PROCESS THAT REQUIRES A DEMOGRAPHIC ANALYSIS, NOT ONLY LOOKING AT THE SIZE OF OUR POPULATION IN TERMS OF TOTAL SIZE, BUT ALSO IN TERMS OF OTHER SMALLER GROUPS, VOTING AGE POPULATION, AS WELL AS CITIZEN VOTING AGE POPULATION.

WE NEED TO DETERMINE HOW TRUSTEES ARE GOING TO PROVIDE INPUT IN THIS PROCESS.

THIS IS A TRUSTEE PROCESS AND HOW WE'RE GOING TO GET COMMUNITY INPUT AS WELL.

THEN LOOK AT PLANS AND ALTERNATIVE PLANS BASED ON TRUSTEE COMMUNITY INPUT AND LEGAL REQUIREMENTS.

THEN FINALLY, ADOPT THAT PLAN.

DROP DEAD DEADLINE FEBRUARY, BUT THE DEADLINE WE REALLY WANT YOU TO BEGIN THINKING ABOUT BEING DECEMBER OF 2021.

AS I SAID, THE CORNERSTONE INFORMATION THAT YOU NEED FOR REDISTRICTING IS THE DATA THAT IS RELEASED BY THE CENSUS BUREAU EVERY 10 YEARS.

TYPICALLY, IT'S RELEASED BY APRIL 1, THE YEAR FOLLOWING THE CENSUS, SO THE CENSUSES IN 2020, SO BY APRIL 1 OF 2021 THAT DATA IS RELEASED.

THE CENSUS BUREAU HAS BEEN HAVING OPERATIONAL DELAYS AS A RESULT OF COVID-19.

THEY PROMISED DATA IN JULY, THEY'RE NOT GOING TO MAKE THAT DEADLINE, THEY'RE PROMISING DATA NOW, THE MIDDLE OF AUGUST AND ON A ROLLING BASIS THROUGH THE END OF SEPTEMBER.

ALL OF THE DATES THAT WE'RE DISCUSSING TODAY IN OUR PRESENTATION REALLY ARE CONTINGENT UPON THIS BOARD RECEIVING THE DATA BETWEEN THAT TIME PERIOD, MID AUGUST OF 2021 TO THE END OF SEPTEMBER OF 2021.

IF WE DON'T RECEIVE THAT DATA WITHIN THAT WINDOW OR SUBSTANTIALLY LATER THAN THAT WINDOW, IT IS POSSIBLE THAT WE CAN'T MEET OUR DEADLINE TO REDISTRICT IN TIME FOR YOUR MAY OF 2022 ELECTION.

WHAT THAT WOULD MEAN THEN IS THE FIRST ELECTION AT WHICH YOU CAN ACTUALLY ACT ON THAT DATA IS NOT MAY OF 2022, IT'S MAY OF 2023, SO YOU WOULD GO TO YOUR NEXT REGULAR ELECTION.

YOU WOULDN'T GO TO ANOTHER UNIFORM ELECTION DATE BECAUSE YOU DON'T HAVE NORMAL TRUSTEE ELECTIONS.

FOR EXAMPLE, ON NOVEMBER, YOU WOULD GO TO YOUR NEXT IRREGULAR ELECTION DAY, WHICH IS IN MAY OF 2023.

BUT WE ARE HOPEFUL ALL SIGNS ARE LOOKING GOOD SO FAR THAT THE DATA IS GOING TO BE RELEASED IN A VERY RAW FORM EARLY AUGUST AND THEY'LL KEEP REFINING IT ALL THE WAY THROUGH THE END OF SEPTEMBER OF 2021.

THE DATA THAT YOU RECEIVE IS A TOTAL POPULATION NUMBER AT VARIOUS UNITS OF GEOGRAPHY, THE SMALLEST BEING A CENSUS BLOCK.

THINK ABOUT THAT AS A COUNTY PRECINCT, YOU'RE GOING TO GET TOTAL POPULATION INFORMATION FOR COUNTY PRECINCTS THAT MAKE UP YOUR SINGLE-MEMBER DISTRICTS, YOU'RE GOING TO GET VOTING AGE POPULATION, SO THAT INDIVIDUALS OVER 18 AS CENSUS DAY AS WELL AS CITIZEN VOTING AGE POPULATION.

WHY ARE THOSE THREE UNITS OF MEASUREMENT IMPORTANT? BECAUSE THEY REALLY GO TO THREE DIFFERENT AREAS OF THE LEGAL ANALYSIS AS TO WHETHER YOU HAD A WELL-BALANCED PLAN.

THREE QUESTIONS THAT YOU'RE GOING TO USE THIS DATA THAT YOU'RE GETTING FROM THE CENSUS BUREAU TO ANSWER, ARE MY SINGLE-MEMBER DISTRICTS WELL-BALANCED? THE ANSWER TO THAT IS, IS THE DIFFERENCE BETWEEN THE MOST POPULOUS DISTRICTS, SO THE LARGEST IN TERMS OF POPULATION, NOT IN TERMS OF PHYSICAL SIZE, THE DIFFERENCE BETWEEN THE LARGEST POPULATED DISTRICT AND THE LEAST POPULATED DISTRICT, IS IT A GREATER THAN 10 PERCENT? WE'RE NOT WELL-BALANCED.

IS IT LESS THAN 10 PERCENT? WE'RE WITHIN BALANCE.

WE'RE GOING TO USE A TOTAL POPULATION NUMBER TO ANALYZE THAT QUESTION.

HAS THERE BEEN ANY RETROGRESSION IN THE VOTING STRENGTH OF ANY MINORITY GROUPS, IN PARTICULAR, IN A MAJORITY-MINORITY SINGLE-MEMBER DISTRICTS SINCE THE LAST TIME WE ADOPTED A PLAN, SO SINCE 10 YEARS AGO? HAS THERE BEEN ANY RETROGRESSION IN TERMS OF THE NUMBER OF PEOPLE OVER THAT 50 PERCENT THRESHOLD IN THAT SINGLE MEMBER DISTRICT? IF THERE HAS BEEN, WE ARE LEGALLY REQUIRED TO ADDRESS THAT ISSUE SO THAT WE DON'T HAVE RETROGRESSION GOING INTO THE NEW PLAN, EVEN IF WE HAVE TO REBALANCE IN ORDER TO COMPLY WITH STATE AND FEDERAL LAW REGARDING THE 10 PERCENT DEVIATION.

THEN EVEN THOUGH WE ARE ALLOWED TO AVOID RETROGRESSION WITH RESPECT TO MINORITY VOTE DELETION, WE'RE NOT ALLOWED TO DO THAT TO THE ABSOLUTE EXCLUSION OF ANY OTHER TRADITIONAL REDISTRICTING PRINCIPLES.

MEANING KEEPING NEIGHBORHOODS THAT ARE ALIKE TOGETHER, NOT SPLITTING COUNTY PRECINCTS, OBSERVING NATURAL BOUNDARIES TO THE EXTENT POSSIBLE, OBSERVING AND TRYING TO MAINTAIN YOUR PREVIOUS DISTRICT LINES, PRESERVING THE INCUMBENCY, SO NOT DRAWING SOME MEMBER DISTRICTS THAT DISTRICT OUT CURRENT INCUMBENTS OR CURRENT TRUSTEES AND THE POSITION.

A PLAN IS ALWAYS OBSERVED OR LOOKED AT OR ANALYZED AS TO WHETHER IT IS OBSERVED WITH THOSE PRINCIPLES TO THE EXTENT POSSIBLE, TO THE EXTENT THEY DON'T COME IN CONFLICT WITH OUR OBLIGATION NOT TO HAVE RETROGRESSION SINCE THE LAST PLAN AND THAT'S WHAT THE NEXT COUPLE OF SECTIONS OF THIS PRESENTATION IS ABOUT, IS HOW WE ANSWER THOSE THREE QUESTIONS USING VERY SPECIFIC LEGAL ANALYSIS.

MY NAME IS LAURA MCLAIN AND I'M WITH US OFF ON ONE OF THE THINGS THAT LISA POINTED OUT IN ONE OF OUR SLIDE, WHICH IS THE PURPOSE AND PART OF THIS MEETING IS TO UNDERSTAND SOME OF THE LEGAL REQUIREMENTS AND PRINCIPLES THAT GUIDE THIS PROCESS.

I'M GOING TO BE SPEAKING ABOUT THE FEDERAL GUIDANCE, AND THE FEDERAL LAWS, AND THE FEDERAL CASES THAT GUIDE US ON THIS AND CHRISSY NEXT TO ME WILL BE ADDRESSING SOME OF THE STATE LAW REQUIREMENTS AND SO WHAT YOU'RE GOING TO FIND IS YOU'RE GOING TO SEE CRITERIA OR FACTORS THAT REALLY SOME ARE TRULY REQUIRED.

THEY'RE JUST PART OF WHAT'S OUT THERE THAT WE HAVE TO FOLLOW AND THERE'S GOING TO ALSO BE FACTORS OR CRITERIA THAT ARE SET BASED ON CASE LAW AND BASED ON FEDERAL LAW AND THE GUIDANCE THAT WE HAVE RECEIVED UP UNTIL THIS TIME.

ONE CRITICAL PRINCIPLE IN THIS PROCESS IS THE PRINCIPLE OF ONE PERSON, ONE VOTE.

NOW THIS IS A PRINCIPLE OF LAW, FOR LACK OF A BETTER TERM, THAT HAS BEEN IN EXISTENCE SINCE THE 1960S AND THE EQUAL PROTECTION CASES THAT CAME OUT OF THE WARREN COURT AT THAT TIME AND THE BASIC PRINCIPLE IS THAT WE WANT TO DRAW DISTRICTS THAT HAVE A SUBSTANTIALLY EQUAL POPULATION WITH THE THEORY BEING THAT WHEN YOU HAVE A SUBSTANTIALLY EQUAL POPULATION WITHIN A DISTRICT OR AS COMPARED TO OTHER DISTRICTS, THAT IN FACT THERE IS EQUAL OPPORTUNITY FOR REPRESENTATION.

THAT'S ONE OF THE BASIC PRINCIPLES THAT COVERS THIS PARTICULAR PROCESS. WE GO TO SLIDE 14.

ANOTHER PROCESS OR ANOTHER PRINCIPLE RATHER THAT GUIDES US IS ALSO THE FACTOR OF RACE.

TO WHAT EXTENT IT CAN BE CONSIDERED OR SHOULD NOT BE CONSIDERED AND THAT WAS REALLY ESTABLISHED, ONCE AGAIN, THROUGH FEDERAL CASE LAW THAT CAME DOWN THROUGH THE US SUPREME COURT AND THE INFAMOUS CASE FOR THAT WAS THE SHAW VERSUS RENO CASE, WHICH WE HAVE ADDRESSED HERE IN SLIDE 14 AND BASICALLY, THE RESULT FROM THE SHAW VERSUS RENO CASE, WHICH WAS REALLY A GERRYMANDERING CASE IS WHAT IT WAS, WAS BASICALLY THAT RACE REALLY IS NOT TO BE SOMETHING THAT SHOULD BE CONSIDERED.

THERE CAN BE CIRCUMSTANCES WHERE RACE CAN, IN FACT, BE THE PREDOMINANT FACTOR.

BUT, IF YOU MOVE TO THE NEXT SLIDE, THAT'S VERY LIMITED CIRCUMSTANCE.

THE PROCESS THAT IS CONSIDERING RACE HAS TO BE NARROWLY TAILORED TO MEET THE COMPELLING STATE INTEREST AND WHAT IS A COMPELLING STATE INTEREST? FEDERAL LAW LOOKS AT WHETHER OR NOT A PARTICULAR PROCESS, SUCH AS THE REDISTRICTING PROCESS, WHETHER A FINAL PLAN, PROPOSED PLAN THAT'S BEEN ADOPTED, DOES THAT IN FACT HAVE AN EFFECT? WE ARE LOOKING ULTIMATELY, WHEN YOU HAVE VOTING RIGHTS ACT AND VOTING RIGHTS ACT LITIGATION OR CHALLENGES, THEY ARE LOOKING AT THE ULTIMATE EFFECT OF WHAT IS THAT ADOPTED PLAN.

THAT IS THAT MEMBERS OF A CONCENTRATED MINORITY GROUP THAT HAVE BEEN DIVIDED BY VIRTUE OF THE REDRAWING OF THOSE LINES AND THEN BY DOING SO, WE'RE BASICALLY DEPRIVING THE GROUP OF THE ABILITY TO ELECTED CANDIDATE OF THEIR CHOICE THAT THEY OTHERWISE WOULD HAVE HAD IF THEY NOT HAD BEEN SPLIT BY THE REDRAWING OF A LINE.

THE INVERSE OF THAT IS THE SECOND EXAMPLE OF WHERE YOU COULD HAVE AN EFFECT THAT IS ALLEGED FOR PURPOSES OF A VOTING RIGHTS ACT CLAIM AND THAT IS PACKING WHERE YOU TAKE MINORITY GROUP MEMBERS AND THEY ARE PLACED INTO ONE OR MORE DISTRICTS IN SUCH HIGH CONCENTRATIONS THAT CLEARLY EXCEED THE AMOUNT NEEDED TO ELECTED CANDIDATE OF THEIR CHOICE.

THEREFORE, WHEN YOU DO THAT, YOU ARE IN THEORY PREVENTING THE GROUP FROM WINNING ELECTIONS IN OTHER DISTRICTS IN WHICH THE EXCESS MINORITY VOTERS COULD HAVE BEEN LOCATED.

THOSE ARE JUST SOME EXAMPLES OF WHAT WE DEAL WITH WITH REGARDS TO VOTING RIGHTS ACT CHALLENGES AND CONCERNS THAT GUIDE US THROUGH THIS PROCESS WHEN WE'RE REDRAWING.

THEY MAY HAVE FIVE IN SINGLE-MEMBER DISTRICTS AND TWO TRUSTEES ELECTED AT LARGE, FOR EXAMPLE, BUT YOU ALL DON'T HAVE TO WORRY ABOUT THAT, YOU ARE ALL NINE IN SINGLE-MEMBER DISTRICTS.

AS LISA MENTIONED AT THE TOP, ANOTHER ONE OF THE CONSIDERATIONS THAT IS SOMEWHAT UNIQUE TO DALLAS ISD HAS TO DO WITH THE STUDENT ENROLLMENT.

A SCHOOL DISTRICT THAT EDUCATES AS MANY KIDS AS YOU ALL DO HAS TO ALSO THINK NOT ONLY ABOUT YOUR OWN SINGLE-MEMBER DISTRICT BOUNDARIES, BUT ALSO COUNTY VOTING PRECINCT LINES.

WE HAVE TO AVOID DRAWING SINGLE-MEMBER DISTRICTS THAT CROSS THOSE COUNTY PRECINCT LINES UNLESS THEY COINCIDE WITH SCHOOL DISTRICT BOUNDARIES.

SO SCHOOL DISTRICTS THAT DO HAVE THAT SITUATION AND NOT EVERYONE DOES.

I THINK THAT THE REASON WHY NORTH DALLAS HAS BEEN UNDER-INVESTED IN AS A SCHOOL FOR THE LAST 30 YEARS FOUR TRUSTEES THAT REPRESENT THAT FEEDER PATTERN.

IT'S THE POINT AT WHICH FOUR DIFFERENT TRUSTEE DISTRICTS ALIGN.

TO TRUSTEE FOREMAN'S EARLIER COMMENT ABOUT THREE TRUSTEE DISTRICTS ALIGNING IN WEST DALLAS, THERE'S FOUR ALIGNING IN BUT I DON'T HAVE ANY OF THE SCHOOLS THAT FEED INTO IT.

THAT DOESN'T MAKE ANY SENSE, AND AS A RESULT, THAT SCHOOL GETS LESS.

I WILL ALSO ADD THAT WHEN YOU PUT IT IN MY TRUSTEE DISTRICT, WHERE 90 PERCENT OF THE VOTERS WHO VOTE IN MY DISTRICT ARE IN THE WOODROW AND HILLCREST FEEDER PATTERN.

IF YOU'RE A TRUSTEE WHO IS ONLY PAYING ATTENTION TO TRYING TO MAKE YOUR CONSTITUENTS HAPPY, YOU DON'T GIVE NORTH DALLAS ANYTHING.

YOU TAKE ALL THAT AND YOU GIVE IT TO WOODROW AND HILLCREST.

I'VE STRIVED HARD NOT TO DO THAT, BUT THAT'S WHAT THE NATURAL HUMAN INCENTIVE STRUCTURE IS FOR ELECTED OFFICIALS, IS TO MAKE THE PEOPLE THAT VOTE HAPPY, AND THAT WE NEED TO LINE UP THE FEEDER PATTERNS IN A WAY THAT OVERLAPS WITH THE TRUSTEE DISTRICTS.

IF TRUSTEE CARREON HAD ALL OF THE NORTH DALLAS FEEDER PATTERN, THAT VOTER TURNOUT IN MY DISTRICT IS MEANINGLESS.

BUT IN HIS DISTRICT, THAT WOULD BE A BIG DEAL AND THAT WOULD ALIGN HIS INCENTIVES WITH THE BEST INTERESTS OF THE KIDS IN THE NORTH DALLAS FEEDER PATTERNS.

I THINK WE'VE REALLY GOT TO PRIORITIZE FEEDER PATTERN ALIGNMENT AS MUCH AS POSSIBLE.

TO THAT END, I DON'T KNOW WHO TO REQUEST THIS.

IF WE, FOR THE REDISTRICTING PROCESS, HAVE A REALLY GOOD REASON TO KEEP A SCHOOL OR A SERIES OF SCHOOLS OUT OF THAT FEEDER PATTERNS TRUSTEE DISTRICT FOR A GOOD REASON THAT IS A VALID REDISTRICTING REASON, I WOULD SUBMIT THAT WE SHOULD REACTIVATE THE BOUNDARY COMMITTEE, AND THAT ANY SCHOOL THAT WE INTENTIONALLY KEPT OUT OF THE TRUSTEE'S DISTRICT, BE SUBJECT TO REVIEW BY THE BOUNDARY COMMITTEE.

WITH THE IDEA OF MAYBE IF THERE WAS A REASON THAT THAT SCHOOL SHOULDN'T BE IN THE TRUSTEE DISTRICT, MAYBE IT'S IN THE WRONG FEEDER PATTERN.
